A Comissão de Constituição e Justiça e de Cidadania da Câmara dos Deputados aprovou o Projeto de Lei 2762/19, do deputado Flavio Nogueira (PT-PI), que classifica o estágio curricular como experiência profissional. A proposta muda a Lei do Estágio.
Pelo texto, caberá ao poder público regulamentar as hipóteses em que o estágio valerá para as provas em concurso público.
A proposta tramita em caráter conclusivo e, portanto, poderá seguir ao Senado, a menos que haja recurso para votação também no Plenário.
O relator, deputado Pedro Campos (PSB-PE), destacou a importância do projeto. “O jovem não consegue trabalhar porque não teve um emprego anterior e não adquire experiência pelo fato de antes não ter trabalhado. Essa triste realidade tende a ser corrigida a partir da aprovação desta matéria”, disse.
Desemprego
Dados da Pesquisa Nacional por Amostra de Domicílios Contínua (Pnad Contínua), do Instituto Brasileiro de Geografia e Geografia e Estatística (IBGE), divulgados na semana passada, mostram que os jovens enfrentam maiores dificuldades em encontrar emprego.
De 18 a 24 anos, a taxa de desocupação foi de 18% no primeiro trimestre deste ano, contra 8,2% na faixa de 25 a 39 anos. A média geral da taxa de desocupação do país, segundo a pesquisa, foi de 8,8% no período.

A Câmara dos Deputados aprovou, por 372 votos a 108, o texto-base do projeto de lei complementar que fixa novas regras fiscais para as despesas da União, o chamado arcabouço fiscal. A medida substituirá o atual teto de gastos, criado ainda no governo de Michel Temer. Ainda faltam destaques a serem votados, o que deve ocorrer nesta quarta-feira (24). Após essa etapa, o texto seguirá para o Senado.
A proposta do arcabouço fiscal foi enviada em abril pelo governo federal ao Congresso Nacional. O relator do projeto, deputado Cláudio Cajado (PP-BA), incluiu gatilhos para obrigar o corte e a contenção de gastos no caso de descumprimento da meta fiscal.
O novo arcabouço fiscal limitará o crescimento da despesa a 70% da variação da receita dos 12 meses anteriores. Em momentos de maior crescimento da economia, a despesa não poderá crescer mais de 2,5% ao ano acima da inflação. Em momentos de contração econômica, o gasto não poderá aumentar mais que 0,6% ao ano acima da inflação.
Durante todo o dia, Cajado esteve reunido com o presidente da Câmara, Arthur Lira, costurando mudanças pontuais no relatório. Uma delas dá possibilidade do governo gastar mais do que o previsto, desde que arrecade mais que o previsto também. Os gastos serão condicionados ao cumprimento de metas de resultado.
O placar provocou comemoração na base do governo. Por se tratar de um Projeto de Lei Complementar, eram necessários, no mínimo, 257 votos para aprovação. A aprovação por uma margem larga, com um clima político favorável, deixa o governo mais confortável para a votação no Senado.
Gatilhos
Chamado de Regime Fiscal Sustentável pelo relator, o projeto prevê que, no caso de descumprimento das metas, haverá contingenciamento (bloqueio) de despesas discricionárias. O projeto de Cajado estabelece a adoção, no ano seguinte ao descumprimento, de medidas automáticas de controle de despesas obrigatórias, como a não concessão de aumento real de despesas obrigatórias e a suspensão de criação de novos cargos públicos e da concessão de benefícios acima da inflação.
Caso o descumprimento aconteça pelo segundo ano consecutivo, novas proibições serão acrescentadas às existentes, como o aumento de salários no funcionalismo público, admissão ou contratação de pessoal e realização de concurso público (nos últimos dois pontos, a exceção é para reposição de cargos vagos).
Segundo Cajado, o reajuste real do salário mínimo estará fora dos gatilhos e terá aumento acima da inflação. Inicialmente, havia previsão de também retirar o Bolsa Família do limite de gastos. No entanto, o deputado manteve o benefício sujeito às normas gerais para que seja reajustado acima da inflação.

Türk destacou que as ofensas são um “lembrete gritante”

O alto comissário da Organização das Nações Unidas para os Direitos Humanos, Volker Türk, condenou nesta quarta-feira (24) os atos de racismo contra o jogador de futebol brasileiro Vini Jr., atacante do clube espanhol Real Madrid, ocorridos no último domingo (21).
Em coletiva de imprensa, Türk destacou que as ofensas são um “lembrete gritante” da prevalência do racismo no esporte. “Apelo aos organizadores de eventos desportivos para que tenham estratégias de prevenção e combate ao racismo”, disse.
“Muito mais precisa ser feito para erradicar a discriminação racial – e isso precisa começar ouvindo as pessoas de ascendência africana, envolvendo-as significativamente e tomando medidas genuínas para agir de acordo com suas preocupações”, concluiu.
Apoio de autoridades
Desde o ocorrido, o atleta tem recebido apoio de autoridades do Brasil, personalidades do esporte e colegas do clube espanhol. O governo brasileiro divulgou, no início da semana, nota de repúdio aos ataques racistas.
O governo federal cobrou urgência na adoção de medidas sobre a recorrência de casos de racismo cometidos contra o atleta na Espanha. Assinam a nota os Ministérios das Relações Exteriores, da Igualdade racial, da Justiça e Segurança Pública, do Esporte e dos Direitos Humanos e da Cidadania.
“Insta as autoridades governamentais e esportivas da Espanha a tomarem as providências necessárias, a fim de punir os perpetradores e evitar a recorrência desses atos”. As instituições citadas no texto são a Federação Internacional de Futebol (Fifa), a Federação Espanhola e La Liga.
Em publicação nas redes sociais, o ministro dos Direitos Humanos e da Cidadania, Silvio Almeida, cobrou uma postura mais firme de entidades esportivas, governos, patrocinadores e da imprensa. Ele criticou a posição do presidente da La Liga, Javier Tebas.
“Em vez de se solidarizar com Vini Júnior, o presidente de La Liga resolve atacar o atleta pelas redes sociais. Para além do destempero do cartola, seria o caso de se perguntar como as empresas que patrocinam a La Liga se posicionam”, afirmou o ministro.
O ministro da Justiça e Segurança Pública, Flávio Dino, prestou solidariedade ao jogador atacado e exigiu ações concretas dos empresários que financiam eventos futebolísticos. “Isso é deplorável, inaceitável e deve ter consequências. Espero que essas empresas façam alguma coisa de sério e efetivo sobre o inaceitável e reiterado racismo contra Vinicius Júnior”.
O Ministério da Igualdade Racial afirmou, em seu perfil no Twitter, que o Brasil vai notificar oficialmente as autoridades espanholas e a La Liga, responsável pelo torneio de futebol profissional espanhol.
“O governo brasileiro não tolerará racismo, nem aqui, nem fora do Brasil! Trabalharemos para que todo atleta brasileiro negro possa exercer o seu esporte sem passar por violências”. Já a ministra Anielle Franco postou: “Inaceitável! O peito chega aperta de tanta indignação! Até quando teremos que lidar com isso!? Chega de racismo!”
O vice-presidente da República e ministro do Desenvolvimento, Indústria, Comércio e Serviços, Geraldo Alckmin, no Twitter, considerou inaceitáveis os ataques racistas sofridos por Vini Jr. “O racismo deve ser combatido ativamente e rechaçado em todos os cantos do mundo”.
Liga
Em nota, a La Liga, liga de futebol profissional de clubes da Espanha, informou que solicitou todas as imagens disponíveis para investigar o ocorrido. “Concluída a investigação, caso seja detectado um crime de ódio, a La Liga passará a tomar as medidas legais cabíveis”.

Objetivo é identificar quem não repassou redução de preços

Começou nesta quarta-feira (24) o mutirão da Secretaria Nacional do Consumidor (Senacon) para monitorar postos de combustíveis que não reduziram os preços médios de venda de gasolina e diesel, após a queda de preços promovida pela Petrobras.
No dia 16 de maio, a Senacon emitiu um ofício aos Procons estaduais e municipais, solicitando esse monitoramento em postos de combustíveis de todo o país. O documento instruía as unidades do Procon a fazerem um levantamento detalhado dos preços.
No dia 18, foi anunciado que o mutirão iniciaria nesta quarta-feira. Durante o evento, o secretário Nacional do Consumidor, Wadih Damous, disse que a redução anunciada pela Petrobras e pelo governo federal foi adotada com o objetivo de beneficiar toda a população, e não de favorecer um setor que, segundo ele, “talvez seja o mais cartelizado da economia brasileira”.
O secretário tem reiterado críticas contra “fraudes e abusos” que, segundo denúncias apresentadas à Senacon, estariam sendo praticadas por postos de combustíveis. No ofício encaminhado aos Procons, Damous disse que não aceitará situações desse tipo.
Em entrevista ao programa A Voz do Brasil, da Empresa Brasil de Comunicação (EBC),nesta semana, o ministro de Minas e Energia, Alexandre Silveira, declarou que haverá “mão firme do governo para que a queda do preço chegue na bomba”.
Formulário
A Senacon abriu um canal de denúncias contra postos de gasolina. Nos primeiros dias, mais de mil denúncias de preços abusivos foram registradas.
Para fazer a denúncia, basta preencher um formulário simples, com dados básicos do denunciante e da empresa denunciada. O formulário foi disponibilizado na internet no site da Senacon.
No dia seguinte, a empresa anunciou redução R$ 0,44 por litro do preço médio do diesel para as distribuidoras, que passou de R$ 3,46 para R$ 3,02. A redução do preço médio da gasolina foi de R$ 0,40 por litro, passando de R$ 3,18 para R$ 2,78, valor também pago pelas distribuidoras.
Com a nova política da estatal, as referências de mercado coloca o custo alternativo do cliente como prioridade na precificação; e considera o valor marginal para a Petrobras, tendo por base custos e oportunidades observadas em diversas etapas da atividade, entre elas, produção, importação e exportação de produtos.
As premissas, segundo nota divulgada pela empresa, são preços competitivos por polo de venda, participação “ótima” da Petrobras no mercado, otimização dos seus ativos de refino e rentabilidade de maneira sustentável.
Segundo a estatal, os reajustes continuarão sendo feitos sem uma periodicidade definida e evitará repasses da volatilidade dos preços internacionais e do câmbio aos consumidores brasileiros.

Offer represents 5.4% of company’s market cap, making it the largest shareholder

With Alpargatas shares down more than 50% in a year and a change in management, the Moreira Salles family has decided to increase its bet on the asset by placing a bid that could make it the company’s largest shareholder. The shareholder already forms a controlling block together with Itaúsa.
MS Alpa, an institution controlled by the controlling shareholders of Alpa Fundo de Investimento and Cambuhy Alpa Holding, both owned by the Moreira Salles family, has proposed to buy up to 32 million of the company’s preferred shares for R$10.5 each – a premium of 17.2% over the price of the stock at last Friday’s closing, of R$8.96, and of 27.7% over the weighted average of the last 30 days, but practically half of the price of a year ago, of R$20.76.
The bid represents a total of R$336 million, or 5.4% of Alpargatas’ market capitalization. If the deal goes through, Cambuhy and Alpa Fundo will have a combined share of 33%, or one-third of the company, surpassing Itaúsa, the current owner of the largest stake, with 29.3%. Today, Cambuhy holds 22.7% and Alpa Fundo has a 4.85% stake. Itaú BBA will mediate the offer, which will be valid for 30 days.
After the announcement of the proposal, Alpargatas shares opened Monday’s trading session with a strong rise.
The proposal comes as Alpargatas searches for a new CEO to replace Roberto Funari, who stepped down at the end of April. Board member Luiz Fernando Edmond took over on an interim basis, at a time when the company is trying to return to growth and profitability.
In the first quarter, the company posted a loss of R$199.7 million, reversing the net profit of R$112.1 million reported in the same period last year. In 12 months, Alpargatas has dropped 56.84% in the stock exchange.
After the result, Citi analysts cut the recommendation for Alpargatas to neutral from buy and the target price to R$10 from R$21, seeing the challenges that the company must go through in its restructuring to unlock long-term opportunities. They said that the company has presented successive quarters of results below expectations and that the new management seems to understand that the problem is not only the current macroeconomic issues.

Secretariat of Federal Revenue is cracking down on some sellers in online marketplaces who falsify data to avoid taxes

The Finance Ministry and the Secretariat of Federal Revenue are expected to present changes to the current system of international shipments of products purchased by consumers on foreign websites and apps, following discussions and meetings with the industry in recent weeks. Contacts between the tax authority, retailers, and platforms have intensified since the government announced a crackdown on online purchases that enter the country without properly paying taxes.
The main change will be the prepayment of taxes at the time of purchase, which is already required by law. The government is not creating a new tax. The import tax of 60% will continue to apply to all purchases (by portal or air shipment) by individuals up to $3,000 – this item was not discussed. Shipments of products such as gifts (not commercial transactions) up to $50 remain exempt.
Valor had access to this compliance program developed by the Secretariat of Federal Revenue, which can be adopted by foreign companies operating in the country, such as Shein, Shopee, AliExpress, and Wish. The model, called Remessa Conforme, will be better detailed to Finance Minister Fernando Haddad after he returns from Japan for eventual adjustments, but in the Federal Revenue’s view it is concluded.
Companies will not be forced to join the model, but for those who adopt the rules, the release of the products will be faster, through an access called “green channel.” Those outside the program will fall into a slower “red channel” clearance system.
Local retailers have criticized the government’s decision not to force platforms to comply with the changes. The Undersecretary of Customs Administration is expected to address the issue of the new program on Thursday at an event on e-commerce in São Paulo.
The advance on the project comes weeks after disagreements within the federal government over how to expand inspection and control of online platforms. Consumers reacted strongly to Mr. Haddad’s and the Federal Revenue’s idea to end the exemption for shipments of up to $50, and President Lula, fearing a public backlash, put an end to the discussion.
But this did not stop the pressure from Brazilian businesspeople, who claim that there is an informal commerce in the country, with an annual tax evasion of R$20 billion to R$40 billion. Between 70% and 80% of the products imported from online platforms in Brazil come from China, compared with 30% around the world.
Under the changes being debated, consumers will have to pay the taxes related to the importation of goods at the time of purchase on the platform, through a collection document. This is not the creation of a new tax, but only a change in the moment of collection, in order to limit the actions of buyers and sellers who try to avoid customs supervision by manipulating shipping information.
Currently, the payment by the consumer occurs only after the entry of international shipments in the country, on the site of Brazil’s postal company Correios (by cash, through banking bar-coded bills known as boletos, or credit card), but the central problem is that the inspection by Correios does not always identify the need to pay the tax. Correios and Federal Revenue cross-check little information about shipments.
According to data from 2022, only 1.9% of the 176.3 million international shipments that entered the country through Correios had the import declaration for the payment of taxes. Therefore, almost 98% passed through the borders without a declaration, which may include tax evasion and the entry of counterfeit products. Among private-sector operators (Fedex, UBS), purchases with declaration reached more than 70% in 2022, because these carriers bear the payment for this shipment and collect directly from the buyer.
According to the current law, from 1999, the current rate, which will remain in effect, is 60% of the purchase price (including freight and insurance) up to $3,000, from companies to individuals. It is still necessary to pay sales tax ICMS (charged on shipments over $500) and the customs fee of $150.
“Those who want to avoid payment use Correios, but with the change it is very difficult to circumvent the system. By determining the payment at the time of the commercial transaction, between seller and buyer, it is no longer possible to say that it is a transaction between individuals and therefore exempt from tax,” said an executive in a Brazilian retailer.
Under the current law, only individuals who receive something from another individual without any commercial transaction are exempt, up to a limit of $50.
What happens today is that some sellers in online marketplaces falsify data submitted to Correios, often with the knowledge of the buyer, claiming to be an individual and declaring values below $50. The proposal to issue the invoice and payment slip in advance makes it more difficult to commit fraud.
As already discussed, foreign online marketplaces will have to indicate the amount of each tax and postal charge on the product listing page. They will do the calculations for the consumer, detailing each amount. Amazon already operates this way in Brazil.
After that, they will receive the payments from the buyer and split the transaction. The tax portion is passed on to the carrier (Correios), which passes the amount on to the Federal Revenue. The website gets its commission on the sale of the product, and the seller gets the money from the good. In the country, the product follows several possible paths to delivery, depending on the platform’s compliance with the new system. There will be a stamp of the “Remessa Conforme” program for accredited platforms that adhere to the model.
In the last two weeks, the tax authority has been in meetings with Asian platforms and Brazilian retailers to present the ideas, and there was a good understanding on both sides that the model is an advance. There are divergencies, however, over the need for inspections to check those who have the stamp.
“The problem is that Haddad doesn’t want to force anyone to do anything. They understand that there is political pressure against any change, which makes it difficult to make anything mandatory now,” said one source.
Another key point is that the liability of the companies would run up against the aspect of business entities in Brazil. “Some are not even Brazilian companies. And I don’t think tougher enforcement would be appropriate now,” says another person familiar with the discussions.
The Federal Revenue has yet to meet with Mr. Haddad to coordinate the issue, sources say, but if the current draft is approved by the minister, the format is likely to be announced between this week and early June.
Last week, some executives of online retailers raised the hypothesis of a gradual implementation of the program and possible postponement of the advance payment, but with the maintenance of the integrated data exchange between Correios and the Federal Revenue. “There is fear in the sector, but it does not seem to us that the Federal Revenue is willing to postpone this. In conversations they say they are ready. And Correios says it is adapting,” one businessman said.
Retailers want to get this off the drawing board quickly, and foreign platforms, on the other hand, claim that there is strong pressure because local retailers want to defend their markets from competition from Asian online marketplaces “more efficient and with more cash to invest,” as a general manager of a platform summarized. “We understand that the game must be equal, but we also understand that even with 60% tax, we will still be competitive with strategies that we have yet to launch,” he said.
The program may be added to the Federal Revenue’s normative instruction No. 2124, published in the Daily Gazette in December, a source familiar with the proceedings said. A second hypothesis is that this normative instruction will be reissued with the terms of the new program. In any case, the fact is that the “Remessa Conforme” emerges anchored in the normative, which increases its weight.
This norm establishes that Correios will have to forward to the Federal Revenue, two days before the arrival of each shipment in the country, a form with 37 information from the buyer (such as tax ID number, purchase value, and full description of the contents).
The Asian platforms will have to provide the data to Correios and private-sector operators, which will send it to the Federal Revenue. The change will allow the tax authority to identify the tax IDs that move large volumes of purchases.
In other words, it will be up and running in just over a month and the “Remessa Conforme” would come in this environment of change.
Asked to comment on the new program, the Federal Revenue said that when the rules are validated internally, it will make the appropriate disclosure. The Finance Ministry and Correios declined to comment.
This week, there is already an agenda on e-commerce. It is scheduled for Tuesday a public hearing requested by Deputy Julio Lopes to discuss the matter.
It is not yet clear, on the part of the platforms, the measures for future adequacy of the payment system and sending data of all shipments, should the program move forward.
Sought for comment, Shein said it has been closely following the discussion and believes that the potential of a country and an industry is enhanced by “equitable tax justice solutions.” The online platform said it “sees it positively,” but understands that it is “very important the dialogue with the sector and the government” for a solution that is “indeed effective and that seeks to support consumers.”
Last week, Shein’s management team said the company would pay any taxes collected from the consumer – without elaborating on the model and percentage. Companies can afford to pay if they want to – through discounts and coupons – but the industry has been looking for measures to defend the profitability of companies for at least two years, and the payment can affect the margins of the groups. Asked about this, Shein did not comment on whether this payment may involve the Federal Revenue’s program.
AliExpress said it will remain available and cooperative with the government “in favor of who matters most, the consumer.” It says that once the document is received, it will be studied and analyzed so that it can be implemented. Shopee declined to comment.

Arminio Fraga, former president of the Central Bank and founding partner of Gávea Investimentos, says it may be time to lower interest rates in Brazil, but stresses that the Central Bank depends on fiscal support. “The Central Bank in general does an excellent job in this area, nobody there is a sadist. There are people who think that the Central Bank is at the service of the rentiers. It is the government that is at the service of the rentiers, as it is the biggest borrower and thus puts pressure on interest rates.”
According to the economist, the macroeconomic tripod established in 1999 is “totally unbalanced.” However, he says that an increase in the deadline for achieving the inflation target could make the president of the Central Bank “feel protected” to carry out his monetary policy.
The economist defends a new social security overhaul, only four years after the difficult approval of the first one, in addition to the administrative and fiscal reforms. “We have been living for a long time in a short blanket without a solution. There is an absurd lack of priority and quality in public spending,” he said. He criticizes the attempts to undo measures taken by the Bolsonaro administration, such as the revision of the privatization of Eletrobras and the sanitation framework, in addition to this week’s change in Petrobras’s pricing policy: “It’s a kind of Bolivarian vision, it’s part of the design of a country that we know doesn’t work.”
Although he acknowledges the efforts of Finance Minister Fernando Haddad and Planning Minister Simone Tebet for giving straightforward signs of intent to restore fiscal credibility, Mr. Fraga says he is disappointed. “I imagined that the lessons of the PT [Worker’s Party] in power had been reasonably absorbed.” But when asked about his public support for Luiz Inácio Lula da Silva in the election campaign, a decision he links to the defense of democracy, he replies firmly: “I don’t regret my vote. It was a big decision, and it was close.”
In the United States on a short break to be with his family, Mr. Fraga says he is working on a book. “I always get things done, more than I should,” he said. “And I still do a lot of chauffeuring for my grandchildren,” he jokes. Read below the main excerpts from the interview:
Valor:How do you rate the new government so far?
Arminio Fraga: From an economic point of view, I confess that I expected more. I imagined that the lessons of the PT in power, both positive and negative, had been somewhat absorbed and that Brazil was moving towards solving the problems that today hinder its full development. On the macroeconomic side, from the beginning, the speeches of the party in general, including those of the president himself, were worrisome and even furious on fiscal responsibility and the role of the Central Bank. Then, on the micro side, there was a lot of noise around many issues where progress had been made in recent years, always in the opposite direction of what would be desirable. Issues like social security and labor regulations were on the radar. The feeling is that the vision has always been backward. The basic sanitary framework was another issue. Fortunately, Congress did a good job of defending what it had already decided. Now Petrobras, with a kind of Bolivarian vision, is part of a country design that we know does not work. And it also has environmental implications because we are talking about subsidizing fossil fuels. There is also uncertainty about what we are going to do with [Brazilian Development Bank] BNDES and state-run banks in general. I see this whole area much worse than I imagined.
Valor:And what is the impact of all this misguided discourse?
Mr. Fraga: Both the Finance and Planning ministries gave the right signal on the fiscal issue, which is to adjust and restore Brazil’s credibility. It is a fundamental pillar of the macroeconomic tripod. With the interest rates we have, the Central Bank needs help. Our macroeconomic policy is unbalanced, giving too much weight to monetary policy and too little to fiscal policy. This is one of the roots of the current level of interest rates in Brazil, which are extremely high, especially by international standards. The question is what to do about it. For me, number 1 on the list is to regain the lost fiscal responsibility. I give credit to the Finance Ministry in general for initiating the discussion when the president of the Republic was clearly against it. He may be changing his mind now, but he has started running in the opposite direction, believing that the country that has its own currency can spend at will. The truth is that no country receives a strong currency as a divine gift. A strong currency is built every day. And ours, unfortunately, is not [being built]. It is built on colossal interests, and nobody can think that this is good. At least the discussion is now on the right track, which is to work on building a primary balance.
Valor: When will we be able to get out of this discussion to solve the distributive conflict, to face relevant issues for development and improvements for the population, such as health and education?
Mr. Fraga: The distributive conflict is old and exists because of legitimate and huge demands that everyone wants to satisfy. But the question is how. Public spending in Brazil has gone from about a quarter to a third of GDP in the last 30 years. There has been no austerity over time. What there has been is a colossal lack of priority. And it is not possible to convince most people that this is going to stop. For example, administrative reform is an important issue, but there is a total rejection of this government. Public investment, which in fact has been very low for some time, has suffered as a victim of short-sighted choices. What can be done in the short term? What are the priorities? If the Brazilian government were to borrow money at 2% in real terms, it might even be worth taking some risks. How is that going to happen in Brazil? There is an absurd lack of priority and quality in spending. What we should do is obvious: evaluate everything we do and act if we find something that is not working properly or does not represent an adequate priority.
Valor:You often defend the administrative reform, because the expenses with the government apparatus take a lot of the budget. But it takes more time, and the country urgently needs a solution. What are the risks of the public accounts getting out of control?
Mr. Fraga: The risks are high. What could be done is to combine what can be done now with concrete measures that will have an impact in the medium term, but which improve expectations now, such as beginning a debate about one more social security overhaul. An Ipea [Applied Economics Research Institute] report from February shows that even in optimistic scenarios, social security numbers tend to get really worse. Ditto for an administrative reform, which, besides the fiscal impact in the medium term, would improve the state’s efficiency. I’m not even talking about it being passed. But it is not even being considered. And it can be approved by a supplementary law, without even having to amend the Constitution. Another example is the review of tax benefits, but recently, for example, the renewal of the benefits for the free trade zone for 50 years was passed. So how do you do it? The blanket is short, but it is necessary to open all the work fronts and set them in motion to allow a turnaround in expectations and put this country in a position to grow more.
Valor:Is it possible to repeat the 7% growth seen between 1950 and 1980?
Mr. Fraga: If you look at it per capita, that growth was around 4%. It looks less difficult. When you consider that this development strategy exploded and led to a lost decade, and if you take that into account, it goes down to 3% per capita. If sustainable, it would be a huge success. It is not impossible, but I see the government today moving in the opposite direction of what is desirable. If you look at the last four decades, in two of them Brazil had a decline in GDP per capita. For a country that should be closing the gap with the most advanced economies, losing 20 years is sad.
Valor:How to get out of high interest rates with inflation still so resistant? A difficult equation.
Mr. Fraga: There are tools, but the policy needs some convincing. In fact, interest rates are very high, and not just the [key interest rate] Selic. Brazil is paying 6% in real terms over 30 years. I don’t know how anyone can think that our debt is small with that interest rate. What we can do at the moment is to get our accounts in order and try to make the economy work more fairly and efficiently.
Valor:Is it time already to lower interest rates?
Mr. Fraga: Maybe, but it will depend on the fiscal aspect and also on the credit conditions. The Central Bank is doing a great job in this area. Nobody is a sadist. Some people think that the Central Bank is at the service of the rentiers. The government is at the service of the rentiers — because it is the biggest borrower in the economy — and pushing up this interest rate. There is a simple way to assess this. Has inflation been below target? I would say no. So, the problem is different, it is a diagnosis problem.
Valor:And should the inflation target be discussed again?
Mr. Fraga: The goal is adequate; it should be long-term. I would just give it more time to be accomplished, one more year. This alternative deserves reflection by the CMN [National Monetary Council], which should give this mandate to [Central Bank President Roberto] Campos Neto, so he can feel protected. I see many countries in the world implicitly doing something along these lines. The target system is by far the best way to coordinate what the Central Bank and the fiscal area do: the government sets the target; the Central Bank pursues it and is accountable.
Valor:You said you voted for the current president in the name of democracy. How do you see today’s decision?
Mr. Fraga: I do not regret my vote. It was a great decision, and it was that close. As Pedro Malan, Edmar Bacha and I wrote in the open letter to Lula in November, we expected that the economic policy would be reasonable. And there, in the discussions when we were writing that short text, we wanted to give the sense of hope, not of belief, that this was going to happen.
Valor:And do you still see our democracy in danger?
Mr. Fraga: There is a lot of recent literature, many authors who defend the line that democracy is being eaten at its edges. I am not competent to go deep into that debate, but it is a relevant point. And for those of us who have spent so much time without democracy, we can’t play around with it. It is a permanent state, there is a lot of tension in the air between the branches of government. Brazil is radicalized and the world is radicalized. The main defenses are working. What are these defenses? The press, freedom of expression, the third sector, which acts in an absolutely crucial way in several areas, academia, and culture, which gives life to the issues in an inspiring or more playful way. These defenses are activated in Brazil, and it is good that they continue.
Valor:The government has already mentioned that it wants to review the privatization of Eletrobras. Can this happen?
Mr. Fraga: In the case of Eletrobras, a legitimately elected government decided and sold control of the company. Now the new administration wants to backtrack, an unacceptable default. And I think it will not happen because the government probably knows that it would end up losing in the courts.
Valor:In this scenario of strong growth of corporate debt in recent years, with the extension of maturities and reduction of costs, especially through capital markets, what should be the new role of BNDES?
Mr. Fraga: The BNDES has to be strict and justify everything it does. Even though I have the greatest admiration for the bank’s staff, which is one of the best that this country has, they often worked with a rather archaic development model, without justification and evaluation. And this was pushed to its limits during the Rousseff administration. Then there was a course correction. I have never thought that the BNDES should have a fixed size, but I think that it should remain within a strict framework of defining and justifying the reasons for certain actions so that they can be evaluated and then expanded or discontinued. In the past, when I heard the phrase “this sector is strategic,” I started scratching my head. It rarely was. This discussion is healthy, I am not against it, but it is important to review and evaluate.
Valor: You have been involved in areas outside your traditional habitat of economics and finance. Why did you decide to go down this path?
Mr. Fraga: For a few years now, I have been focusing more on the topic of inequality and lack of opportunities. I am involved in three areas, outside my traditional habitat. Two of them are through public policy institutes. IEPS (Institute for Health Policy Studies) and IMDS (Institute for Mobility and Social Development). Both are up and running. The third one reflects my green side. I have always been green. I would love to have a social, liberal, democratic, green party that I could join one day. I have always thought that Brazil should get involved in this area to help with climate change, to take care of the planet’s biodiversity, and also for our quality of life. That should be clear for everyone. I am talking about clean air, clean rivers, clean beaches. Today we have extraordinary examples from Costa Rica and New Zealand. I am a shareholder of the company Re.green, a wonderful project of reforestation with biodiversity of degraded areas, made possible by carbon sales. It has enormous potential. It is a difficult project to carry out, and risky, but you will not find a single person in our company who is not thrilled even in the face of all these challenges.

A Terceira Seção do Superior Tribunal de Justiça (STJ) decidiu afetar um recurso especial de relatoria do ministro Ribeiro Dantas, que corre em segredo de justiça, para definir, no rito dos repetitivos, se o gênero feminino é condição única e suficiente para atrair a aplicabilidade da Lei Maria da Penha e afastar a incidência do Estatuto da Criança e do Adolescente (ECA) nos casos de violência doméstica e familiar praticada contra criança ou adolescente.

A questão submetida a julgamento, cadastrada como Tema 1.186 na base de dados do STJ, está assim ementada: Se o gênero sexual feminino, independentemente de a vítima ser criança ou adolescente, é condição única para atrair a aplicabilidade da Lei 11.340/2006 (Lei Maria da Penha) nos casos de violência doméstica e familiar praticada contra a mulher, afastando, automaticamente, a incidência da Lei 8.069/1990 (ECA).
O colegiado decidiu não suspender a tramitação dos processos que discutem a mesma questão, pois, além de já existir orientação jurisprudencial das turmas componentes da Terceira Seção, eventual demora no julgamento poderia causar prejuízos aos jurisdicionados.
Discussão sobre competência para julgar crimes sexuais contra menores de idade
Segundo o relator, o caráter repetitivo da matéria foi verificado a partir de pesquisa à base de jurisprudência STJ, que recuperou, pelo menos, sete acórdãos e mais de 400 decisões monocráticas tratando da mesma questão.
No recurso especial representativo da controvérsia, o Ministério Público do Pará aponta que o crime de estupro de vulnerável não configura hipótese de violência doméstica e familiar contra a mulher nos termos da Lei Maria da Penha, uma vez que a satisfação da lascívia, por um adulto, em detrimento de uma criança, não perpassa a submissão do gênero, tanto que o crime é praticado contra meninos e meninas, sendo o gênero da vítima irrelevante para a caracterização do delito.
Para o MP/PA, na fixação da competência para julgamento deve prevalecer a vulnerabilidade reconhecida na Constituição Federal e no ECA, independentemente do gênero da vítima menor de idade, a fim de conferir tratamento igualitário para crianças e adolescentes, independentemente do gênero, que venham a ser submetidos à prática delituosa que atente à sua dignidade sexual.

O Código de Processo Civil de 2015 regula, no artigo 1.036 e seguintes, o julgamento por amostragem, mediante a seleção de recursos especiais que tenham controvérsias idênticas. Ao afetar um processo, ou seja, encaminhá-lo para julgamento sob o rito dos repetitivos, o tribunal facilita a solução de demandas que se repetem na Justiça brasileira.

A Primeira Seção do Superior Tribunal de Justiça (STJ) afetou os Recursos Especiais 2.056.866 e 1.938.265, de relatoria do ministro Benedito Gonçalves, para julgamento sob o rito dos repetitivos.
A questão representativa da controvérsia, cadastrada como Tema 1.188 na base de dados do STJ, é “definir se a sentença trabalhista, assim como a anotação na CTPS e demais documentos dela decorrentes, constitui início de prova material para fins de reconhecimento de tempo de serviço”.
Segundo o relator, o tema discutido é apresentado reiteradamente no STJ e representa questão de relevância do ponto de vista do direito processual administrativo. Benedito Gonçalves destacou pesquisa feita pela Comissão Gestora de Precedentes e Ações Coletivas do STJ, mapeando 126 acórdãos e 3.942 decisões monocráticas sobre o assunto.
