Brazil\u2019s Ministry of Mines and Energy will formally request that the ANEEL, the country\u2019s electric power regulator, initiate the termination process of Enel\u2019s electricity distribution concession in S\u00e3o Paulo, Energy Minister Alexandre Silveira announced on Tuesday (16) alongside S\u00e3o Paulo Governor Tarc\u00edsio de Freitas and S\u00e3o Paulo Mayor Ricardo Nunes. The move marks the first official step toward ending the company\u2019s contract.<\/p>\n<\/div>\n

The announcement followed a meeting at the S\u00e3o Paulo state government headquarters between the three officials. Last week, high winds exceeding 90 km\/h\u00a0knocked out power for 2.2 million homes in the metropolitan region served by Enel<\/a>, affecting over 8.5 million people.<\/p>\n<\/div>\n

Silveira, Tarc\u00edsio, and Nunes presented a united front in calling for the contract\u2019s cancellation. \u201cEnel has lost the necessary conditions, reputationally included, to continue providing concession services in S\u00e3o Paulo,\u201d Silveira said. \u201cWe are jointly urging the regulatory agency to start the process of terminating Enel\u2019s concession in S\u00e3o Paulo.\u201d<\/p>\n<\/div>\n

\u201cWe are fully aligned\u2014federal, state and municipal governments\u2014to initiate a rigorous regulatory process. We expect ANEEL to respond as quickly as possible to the people of S\u00e3o Paulo by starting the termination procedure, which will certainly result in better power distribution services,\u201d Silveira added. He did not provide a timeline for ANEEL\u2019s decision.<\/p>\n<\/div>\n

Governor De Freitas called Enel\u2019s situation in the state \u201cabsolutely unsustainable.\u201d \u201cIt can no longer provide services. There is a serious reputational issue, and it repeatedly leaves our population stranded,\u201d he said. \u201cWe have agreed that there is no alternative but to proceed with the most severe measure available in the concession contract: declaring its termination.\u201d<\/p>\n<\/div>\n

\u2018No other alternative\u2019<\/strong><\/p>\n<\/div>\n

He added that both the state and municipal governments will submit studies to the Ministry and Aneel detailing Enel\u2019s repeated failures in S\u00e3o Paulo to support the case for ending the contract. \u201cThere is no other alternative,\u201d he said. \u201cThis is the main regulatory measure available and carries serious consequences, including the suspension of the right to request an early contract renewal.\u201d<\/p>\n<\/div>\n

Enel serves 24 municipalities in the metropolitan area, including the capital. Its contract runs through 2028. Despite repeated outages and service failures, the company has already requested an early renewal from ANEEL.<\/p>\n<\/div>\n

Mayor Nunes reiterated that the federal ministry would press ANEEL to begin the termination process. \u201cEnel lacks the structure and commitment to meet the region\u2019s needs, especially when faced with adverse events stemming from climate change,\u201d he said.<\/p>\n<\/div>\n

Both Nunes and Tarc\u00edsio said the joint meeting of the three government levels was encouraged by President Luiz In\u00e1cio Lula da Silva, who is closely monitoring the issue. On Friday, the governor and mayor briefly spoke to Lula about the situation during the launch event of the SBT News channel in S\u00e3o Paulo.<\/p>\n<\/div>\n

As of 7 p.m. Tuesday, Enel\u2019s website showed 47,526 properties in S\u00e3o Paulo without power, about 0.81% of its clients in the city. On Monday, the number was 25,000. Other cities in the metro area saw double-digit outage rates: S\u00e3o Louren\u00e7o da Serra (13.8%), Ribeir\u00e3o Pires (11.47%), and Juquitiba (10.8%). The storm hit the region on Wednesday (10).<\/p>\n<\/div>\n

Power outages have been a persistent issue for Enel\u2019s service areas in S\u00e3o Paulo. In 2023, 2.1 million homes were left without power; in 2024, the number rose to 2.4 million.<\/p>\n<\/div>\n

In a statement, the S\u00e3o Paulo city government said Enel had signed a cooperation agreement committing to 282,271 tree prunings this year. \u201cHowever, only 31,945 prunings\u201411% of the Annual Pruning Plan\u2014had been completed by the company as of Monday (15),\u201d the statement said. \u201cThis pitiful result proves the concessionaire\u2019s lack of commitment and the poor quality of service provided to the people of S\u00e3o Paulo.\u201d<\/p>\n<\/div>\n
