The debate over the bill that establishes Brazil\u2019s Legal Framework on Organized Crime, scheduled for Tuesday (11) in the Chamber of Deputies, has already sparked a fierce political dispute even before reaching the floor. Members of the government are pushing to restore the original text of the Anti-Gang Law, while the Federal Police (PF) has sharply criticized the report prepared by Federal Deputy\u00a0Guilherme Derrite (Progressives Party, PP, S\u00e3o Paulo).<\/p>\n<\/div>\n

Government officials argue that appointing Mr. Derrite\u2014currently on leave from his post as S\u00e3o Paulo\u2019s Secretary of Public Security\u2014to draft the report undermines technical debate and politicizes the discussion.<\/p>\n<\/div>\n

\n

The choice has heightened political tensions ahead of the 2026 elections, since Mr. Derrite belongs to the circle of S\u00e3o Paulo Governor\u00a0Tarc\u00edsio de Freitas<\/strong>\u00a0(Republicans), widely seen as\u00a0President Lula\u2019s\u00a0(Workers\u2019 Party, PT) main potential challenger. Government allies have escalated their criticism of both the bill and Chamber Speaker\u00a0Hugo Motta<\/strong>\u00a0(Republicans of Para\u00edba), who appointed Mr. Derrite as rapporteur.<\/p>\n<\/div>\n

Minister of Institutional RelationsGleisi Hoffmann\u00a0hinted that the Lula administration is preparing for a political showdown. She said Mr. Derrite\u2019s proposals would serve as a \u201cfree pass\u201d for criminal factions and hinder the Federal Police\u2019s work. One of the most controversial provisions would allow the Federal Police to act only \u201cupon request from the state governor.\u201d<\/p>\n<\/div>\n

\n

According to the minister, if Mr. Derrite insists on maintaining his version, the government will refuse to negotiate and take the dispute to a floor vote, even at the risk of losing. The governing bloc plans to submit an amendment restoring the original text.<\/p>\n<\/div>\n

\n

Mr. Motta and Ms. Hoffmann were scheduled to meet on Monday evening (10), and the minister said she would express her \u201cconcern\u201d over the report. She argued that the Chamber must \u201cundo\u201d the current course before scheduling the vote.<\/p>\n<\/div>\n

\n

\u201cWe need to reverse this. Paralyzing the Federal Police is bad for the country. It will harm Brazil and restrict the Federal Police,\u201d she said, adding that she had asked for a nonpartisan debate. \u201cHe [Motta] chose someone [Derrite] with a very specific ideological stance on the issue,\u201d Ms. Hoffmann told GloboNews.<\/p>\n<\/div>\n

In a statement, the Federal Police said it views the changes with \u201cdeep concern.\u201d \u201cUnder the report presented, the Federal Police\u2019s historic institutional role in combating crime\u2014particularly against powerful criminals and large-scale organizations\u2014could face significant restrictions. Federal Police operations would depend on requests from state governments, creating a real risk of weakening the fight against organized crime.\u201d<\/p>\n<\/div>\n

\n

The Federal Police also warned that limiting its powers would compromise investigations into corruption, drug trafficking, embezzlement of public funds, and human trafficking, calling the proposed changes \u201ca serious setback.\u201d<\/p>\n<\/div>\n

\n

\u201cThe original proposal submitted by the Brazilian government aims to strengthen law enforcement against organized crime. However, the version now under discussion in Congress undermines this goal by introducing structural changes that weaken the public interest,\u201d the statement said.<\/p>\n<\/div>\n

\n

Federal Police members interviewed by\u00a0Valor<\/strong>\u00a0also criticized the bill,\u00a0saying it conflates organized crime and terrorism in several sections<\/a>\u2014another key point of contention between the government and opposition. One official called the report \u201cterrible\u201d and \u201clegally flawed.\u201d<\/p>\n<\/div>\n

\n

In a separate statement, the Federal Revenue Service also voiced concerns, arguing that making Federal Police action dependent on \u201ca request from the state governor opens the door to unacceptable interference, weakens federal authority, all in addition to being unconstitutional.\u201d<\/p>\n<\/div>\n

\n

\u201cThe Federal Revenue relies on the independent operation of the Federal Police to continue joint efforts to dismantle the financial structures of criminal organizations,\u201d the agency added.<\/p>\n<\/div>\n

\n

Mr. Motta said on social media that he helped mediate talks between Mr. Derrite and Federal Police Director-General Andrei Rodrigues to ensure the Federal Police retains its investigative powers against organized crime.<\/p>\n<\/div>\n

\n

People close to the Chamber speaker defended his prerogative to select the rapporteur, dismissing the backlash as \u201coverblown.\u201d They said Mr. Motta had informed the government of his choice in advance and believes the report is being drafted in a \u201ctechnical and nonpartisan\u201d manner. According to his aides, Mr. Motta views the bill as \u201ctough but necessary,\u201d not a \u201cwitch hunt.\u201d<\/p>\n<\/div>\n

\n

He believes the proposal could unite the Chamber around a broad consensus, similar to the recent approval of the Digital Child and Adolescent Statute. \u201cNo one will want to vote against this,\u201d he said, adding that the issue affects most Brazilian states and carries strong popular appeal.<\/p>\n<\/div>\n

\n

President Lula reportedly called Mr. Motta to discuss the bill, but according to aides, the Chamber leader remains \u201ccalm\u201d about Mr. Derrite\u2019s appointment and expects the final version to reflect a \u201cbroad, technical study.\u201d The text will be discussed at a leaders\u2019 meeting on Tuesday.<\/p>\n<\/div>\n

On Monday, Mr. Motta also met with Attorney General\u00a0Paulo Gonet Branco<\/strong>\u00a0and Supreme Court Justice\u00a0Alexandre de Moraes\u00a0<\/strong>to discuss the fight against organized crime, during which the bill was addressed. A separate meeting between Mr. Motta and state governors is scheduled for later this week.<\/p>\n<\/div>\n

Earlier on GloboNews, Mr. Derrite said his report consolidates proposals from several lawmakers. Responding to criticism from National Secretary of Public Security\u00a0M\u00e1rio Sarrubbo<\/strong>\u00a0that the draft removes key provisions such as \u201cfollowing the money and seizing criminal assets,\u201d Mr. Derrite said those items could be reinstated. \u201cThere\u2019s a lot of political ideology involved. The report can be changed before the vote. We can incorporate all suggestions, including that one\u2014which we already apply in S\u00e3o Paulo. And we will preserve the independence of state police forces,\u201d he said.<\/p>\n<\/div>\n

Mr. Sarrubbo told\u00a0Valor<\/strong>\u00a0that Mr. Derrite\u2019s report is \u201cunconstitutional\u201d and effectively equates criminal factions with terrorist groups. On social media, Mr. Derrite said he has been consulting with lawmakers, judges, prosecutors, lawyers, and law enforcement professionals \u201cwho understand the real challenges on the ground\u201d to shape the text. \u201cThis is a cross-party issue, and I\u2019m willing to listen to all sides,\u201d he said.<\/p>\n<\/div>\n

He added that he had accepted proposals to expand financial sanctions against criminal organizations, create a national registry of gang members, and explicitly bar convicted members from holding public office.<\/p>\n<\/div>\n

The ruling Workers\u2019 Party (PT) plans to launch a social media campaign linking the debate on the anti-gang framework to the recent controversy over the \u201cshielding amendment,\u201d which weakened corruption probes against lawmakers before being overturned by the Senate. PT strategists hope to use public outrage over that vote to regain momentum in the current debate.<\/p>\n<\/div>\n

PT national president\u00a0Edinho Silva\u00a0called Mr. Derrite\u2019s appointment \u201cdisrespectful\u201d to lawmakers and said it politicized the issue. \u201cBrazil won\u2019t confront such a serious challenge by turning this into a campaign platform,\u201d he said.<\/p>\n<\/div>\n

The PT\u2019s Chamber leader,\u00a0Lindbergh Farias\u00a0(Rio de Janeiro), said he was \u201cdeeply bothered\u201d by the \u201cterrible\u201d choice of rapporteur, comparing it to \u201cstealing\u201d the authorship of the proposal. He added that the same lawmakers who backed the shielding amendment are now pushing for severe changes to the anti-gang bill.<\/p>\n
